		<description>you can be arrested and released immediately.  if your crime was not violent they have no reason to detain you.  
In this circumstance, I believe that the police detained the individual for questioning, but just b/c your detained doesn&#039;t mean your being arrested.  Being held w/o reason is against the law, but if your suspected of something you can be held for 24 hours.  
In this case, they pulled him off the streets so that those 15 people freaking out about his costume would feel like he was &quot;processed&quot; correctly.  needless to say, i&#039;m looking to emulate it.</description>

		<description>My understanding is that if you&#039;re free to go, you&#039;re not under arrest, and if you&#039;re under arrest, you&#039;re not free to go.  If he was not arrested, he should have wished the officers a nice day and walked away.

If handcuffs and a ride to the police station is arresting...I&#039;m not sure.  He said he stood in a solitary cell for a couple of minutes while they did the report and talked with him.  Didn&#039;t press charges and was released.
